RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT

Welcome to Unleashed Rage Rooms Inc! Before participating in any activities at our facility, please carefully read the following Terms and Conditions. By booking a session and entering our premises, you agree to be bound by these terms.

1. Acceptance of Terms
by using our services, you agree to comply with and be bound by these Terms and Conditions, as well as any other rules or policies that may be established by Unleashed Rage Rooms from time to time. If you do not agree with any part of these terms, you must not use our services.
 

2. Age Restrictions
Participants aged 10–17 must be accompanied by a parent or legal guardian, who must also sign the waiver.ID Requirements: A valid government-issued photo ID is required for all participants aged 18 and older. For minors, the accompanying guardian may also be asked to present ID. Please ensure all IDs are available at check-in.

3. Waiver and Release of Liability
all participants must sign a waiver and release of liability before engaging in any activities at Unleashed Rage Rooms. This waiver acknowledges the inherent risks involved and releases Unleashed Rage Rooms, its owners, employees, and affiliates from any liability for injuries or damages incurred during participation. Participants acknowledge that they are physically fit and have no health conditions that would impair their ability to safely engage in the activities. In the event of an injury or emergency, participants authorize Unleashed Rage Rooms to seek emergency medical treatment on their behalf, and agree to bear all costs associated with such treatment.

4. Damage Liability Policy
Participants will be held responsible for any damage caused to permanent fixtures in the smash rooms, including but not limited to spools, security cameras, speakers, cameras, thermostats, lighting, windows, or any other permanent fixtures not designated for smashing. A minimum $250 fee will be applied for intentionally destroying any of these items. By participating in activities at Unleashed Rage Rooms, participants acknowledge and accept this liability.

5. Booking, Payment, and Deposits

All bookings must be made in advance through our website or by contacting our facility. The remaining balance is due upon arrival for your scheduled session. Prices are subject to change without notice.

6. Cancellation and Refund Policy

Cancellations made at least 24 hours before the scheduled session will receive a refund of the amount paid. Cancellations made within 24 hours of the scheduled session will not be eligible for a refund. All private bookings made via over the phone or by email are required to leave a 50% non refundable deposit of the total amount to secure the private booking slot. Unleashed Rage Rooms reserves the right to cancel or reschedule sessions due to unforeseen circumstances. In such cases, participants will be offered a full refund, including the deposit, or the option to reschedule.

7. Timeliness and Check-In
Please arrive at least 15 minutes before your appointment to allow time for check-in and gear-up. We may have bookings scheduled immediately after your session, so punctuality is important. If you arrive more than 5-10 minutes late, we may not be able to accommodate your party right away, and you may need to wait for availability (up to 1 hour or more during busy times). If you're running late, please call ahead and we will do our best to accommodate or offer a different time slot.

8. Safety Rules

Participants must wear long sleeve shirts, pants, closed toe shoes, we will provided safety gear at all times during their session on top of the mandatory attire. Participants must follow all instructions provided by Unleashed Rage Rooms staff. No outside items or weapons are allowed in the rage rooms. Participants must not be under the influence of drugs or alcohol.

Any violation of safety rules may result in immediate termination of the session without a refund.

9. Conduct
Participants are expected to behave respectfully and responsibly. Any form of harassment, discrimination, or violence will not be tolerated and may result in immediate removal from the premises without a refund.

10. Personal Belongings
Unleashed Rage Rooms is not responsible for any lost, stolen, or damaged personal belongings. Participants are encouraged to leave valuables at home.

11. Accessibility/limitations notice & waiver addendum

At Unleashed Rage Rooms, we are committed to creating an inclusive and welcoming environment. While we aim to accommodate guests with mobility aids, please note that due to the nature of our facility - originally designed as an auto shop and warehouse - there are some accessibility limitations we want to make transparent Entry: We provide a ramp and an overhead door for accessible entrance into the facility. Washroom: Our bathroom is grandfathered in and may not meet full modern accessibility standards. Room Access: Rage room doorways are standard width and cannot be modified. While many mobility devices may fit, some larger wheelchairs may have difficulty entering or navigating certain rooms comfortably. Space Within Rooms: Each room is designed for safety and holds a maximum of 4 participants. The space is limited to ensure a safe smashing environment, which may impact maneuverability for larger mobility aids. Please note that while we aim to make the experience as inclusive as possible, our rooms may include uneven surfaces, loud sounds, flashing lights, and flying debris that could affect individuals with sensory or mobility sensitivities. We are happy to discuss potential accommodations. Modified setups may include seated smashing areas or smaller group sessions to enhance comfort and safety. Staff reserve the right to respectfully decline or modify a session if safety concerns arise that cannot be reasonably mitigated.

12. Privacy Policy and Video/Photo Consent
Unleashed Rage Rooms is committed to protecting your privacy. Any videos or photos if taken or Personal information collected during the booking process will be used solely for the purpose of providing our services and will not be shared with third parties without your consent, except as required by law. Participants are encouraged to record own sessions if they wish to have a video recording.

13. Modifications to Terms and Conditions
Unleashed Rage Rooms reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes your acceptance of any changes.

14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Manitoba. Any disputes arising from these terms will be resolved in the courts of Manitoba.

Participant Information and Acknowledgment of Waiver

By signing below, I acknowledge that I have read, understood, and agree to abide by the Terms and Conditions, including the Waiver and Release of Liability, Damage Liability Policy, Safety Rules, and reviewed the accessibility limitations of the facility and room layout. I accept any associated risks and understand that not all areas may be accessible depending on the size or configuration of my mobility aid. I agree to follow all safety instructions and wear the required protective gear. I waive any claims against Unleashed Rage Rooms related to accessibility limitations and all other provisions stated herein and accept full responsibility for my participation under the conditions described. Unleashed Rage Rooms reserves the right to adjust or limit participation to ensure safety for all guests. If you are under the age of 18, a legal guardian's signature is required.
